Detailed Process For Administration of deceased estates:
We focus on the administration of deceased estates, whether in terms of the deceased’s last will, or in terms of the Intestate Succession Act. We provide Specialised Fiduciary Support which includes amongst other things the following:
- Initial consultation, we will explain the process, timeframes and how the various assets in the estate are dealt with.
- Collect all relevant information and documentation to report the matter to the Master of the High Court to obtain Letters of Executorship/Letters of Authority (Estates with value of R250 000.00 and less) as soon as possible.
- Correspondence with all other stake holders, including SARS, debtors, creditors, heirs.
- Placement of legal advertisements.
- Opening of the estate late account.
- Settle the estate debt and claims in favour of/against the estate.
- Drafting of Liquidation and Distribution accounts/financial accounts.
- Once in a legal position to do so, distribute the estate by transferring assets, paying legacies and the residue as per the approved estate account.
- Obtain final clearance from SARS and the Master of the High Court.
- Transfer of fixed property (referred to attorney).
- End to end administration process.
- Obtaining filing notice to finalise the estate.
In the following instances we provide estate administration services under Power of Attorney:
- If the Executor must appoint an Agent (as directed by the master’s office), to assist with the Administration process and to take full responsibility for the associated duties.
- Where the deceased did not have a Will and an executor needs to be appointed to finalise the administration process.
Fee structure:
3,5% on the gross value of the estate.
6% on any income to the estate.
